The protection of all forms of ownership has been proposed to be enshrined in the draft new Constitution of Kazakhstan. The current Constitution takes into account only two forms - state and private. According to Mazhilis member Azat Peruashev, this does not fully reflect modern economic realities. Experts, he notes, identify at least five to six different types of ownership. For example, the Constitutions of Finland, Lithuania, Latvia, and Azerbaijan recognize municipal ownership, while the Constitutions of China, Brazil, and India also include collective or cooperative ownership. Today, the status of real estate plays an important role in attracting investment.
«I propose that Paragraph 1 of Article 8 in the draft new Constitution read: ‘All forms of property in the Republic of Kazakhstan shall be recognized, guaranteed, and equally protected.’ I am confident that this approach will create conditions for broader participation of business, society, and the state in the economy, promote economic diversification, and improve public welfare,» noted Azat Peruashev, a member of the Mazhilis and the Constitutional Commission.
The draft new Constitution is generating active public discussion. The current Constitution states that everyone has the right to freedom of labor. The country’s Federation of Trade Unions has proposed to supplement this provision by adding ‘the right to decent work.’ According to the organization’s Chair, Satybaldy Dauletalin, this proposal aligns with the standards of the International Labour Organization.
«The concept of ‘decent work’ implies a fair wage. It also includes decent working conditions. A person who leaves for work in the morning should
return home safely in the evening. This is our position. I believe that if this
provision is included in our Constitution, it will become a firm foundation for
workers and citizens,» said Satybaldy Dauletalin, Chairman of Kazakhstan’s Federation of Trade Unions and a member of the Constitutional Commission.
