The Constitutional Commission continues to review incoming initiatives. During public discussions, a proposal was put forward to amend the draft Basic Law regarding the President’s powers to dissolve the legislative body. This was reported at the Commission’s 11th meeting. Previously, the Head of State was required to dissolve the Kurultai in cases of repeated refusal to approve or elect a proposed candidate. It is now proposed to present this provision as a right rather than an obligation, leaving the decision to the President’s discretion. Another proposal aims to establish a more stable and clear system of guarantees for the protection of citizens’ rights and freedoms, as reflected in Article 14, paragraph 2.
«The following wording is proposed for this paragraph: «Human rights and freedoms are inherent to every person, recognized as absolute, and cannot be taken away by anyone». An important addition is also planned for Article 14, paragraph 3. It states that a citizen’s rights arise by virtue of citizenship as a stable legal bond between the individual and the state, implying mutual rights and responsibilities,» said Bakyt Nurmukhanov, Deputy Chairman of the Constitutional Court of Kazakhstan and member of the Constitutional Commission.
