Eighth Constitutional Commission meeting held in Astana

The eighth meeting of the Constitutional Commission was held today. According to Commission Chair Elvira Azimova, the Secretariat has received over 4,000 submissions from citizens through the e-Otinish platform. Alongside positive feedback, concrete and substantive proposals for refining specific articles of the draft new Constitution continue to arrive. Today, Kazakh First Deputy Prosecutor General Zhandos Umiraliyev proposed clarifying the wording of Article 18.

«The second paragraph of this article states that a person may not be detained without a court decision for longer than the period prescribed by law. Overall, the wording is correct. However, the Russian translation did not render the key concept of ‘exceeding the prescribed detention period’. The suppression of a crime and the immediate isolation of a suspect are among the key responsibilities of law enforcement agencies. Only after that does the court decide whether the person should remain in custody. This is a generally accepted international practice,» Umiraliyev said.
